Kriton Metaxopoulos Managing Partner and head of the IP / patent litigation department, coordinated the defence of a Greek DVD plant, before the German Courts against a patent claim, exceeding 40 million Euros, filed by a world’s leading patent pool association for alleged patent royalty infringement in Germany. The German Supreme Court accepted our arguments and an out of Court agreement was reached. He advised CMS Cameron McKenna’s IP team on a parallel import case, which involved the “repackaging” of goods into boxes of a different size and their importation into an EU country. He was asked by an international IP /TMT experts’ network which provides services to international media companies throughout Europe in order to advise on a matter of TV content distribution. He has also served for almost 20 years in the BoD of Warner Music, which we still represents on various cases. He represented a leading international software company in a major case of copyright infringement. The decision issued by the Felonies Court, was considered to be a break- through in copyright cases. His name has been linked to landmark cases such as the first in Europe decision prohibiting of parallel imports of videocassettes imported from another EU Member State well before the matter was resolved by the European Court of Justice by its famous decision in 2010, the defense of the constitutional rights to publicly perform a cinematographic work even if it is controversial on matters of history, religion (“Last Temptation of Christ”, “Alexander the Great”), that attracted wide publicity.
